JUST IN: Court dismisses Fani Kayode’s fundamental rights suit against FG

An Abuja high court has just thrown away the fundamental rights suit filed by Femi Fani-Kayode over his continued detention by the Economic and Financial Crimes Commission (EFCC).

The former aviation minister who also oversaw communication operations of the Goodluck Jonathan presidential campaign, was remanded in prison custody in Lagos on Tuesday alongside former finance minister Nenadi Usman.

They are facing a 17-count charge of money laundering to the tune of N4.9bn preferred against them by the EFCC.

Fani Kayode had filed a suit while in EFCC custody, challenging his being held by the anti-graft agency, railing that it was a violation of his fundamental rights.

But in Wednesday’s ruling, Justice of the Abuja high court, Adegboyega Adeniyi, held that the EFCC did not breach any law by keeping Fani-Kayode.

He said that the EFCC, having procured a remand order from a magistrate court, acted within its statutory powers.

The judge also held that the remand order procured by the EFCC was in line with the provision of chapter 4 of the 1999 constitution, which allows it to question anyone in the course of an investigation.
